DA REPORT 3/31/13

BURGLARY & ASSAULT
James Anis, age 24, residing at 20 Sharp St., Haverstraw, NY, was indicted on March 27, 2013 by a Rockland County Grand Jury for the crimes of burglary in the first degree and assault in the second degree (three counts). District Attorney Thomas P. Zugibe stated that on or about March 7, 2013 at approximately 6:45 p.m., the defendant entered and remained unlawfully in the dwelling located on Rockland Lane in the Town of Ramapo. In the course of committing the crime, the defendant caused physical injury to two residents of the home and police officer who was in the course of performing a lawful duty.

AUO & DWI
Leslie Branch, age 25, residing at 85 Fred Hecht Dr., Spring Valley, NY, was indicted on March 27, 2013 by a Rockland County Grand Jury for the crimes of aggravated unlicensed operation of a motor vehicle in the first degree and driving while intoxicated. District Attorney Thomas P. Zugibe stated that on or about January 13, 2013 at approximately 4:30 p.m., the defendant was stopped by a Spring Valley police officer while driving on Lawrence Street. The officer observed the defendant to be in an intoxicated state as evinced by the odor of an alcoholic beverage, glassy eyes and impaired motor coordination. Further investigation revealed that defendant’s privilege to operate a motor vehicle had been suspended on three separate occasions.

CRIMINAL POSSESSION OF A FORGED INSTRUMENT
Courtney Burton, age 23, residing at 552 Colorado Avenue, Bridgeport, CT, was indicted on March 27, 2013 by a Rockland County Grand Jury for the crime of criminal possession of a forged instrument in the first degree (26 counts). District Attorney Thomas P. Zugibe stated that on or about July 5, 2012, at approximately 8:00 p.m., at the Palisades Center Mall in West Nyack, the defendant was in possession of counterfeit money in particular twenty-five counterfeit $20 bills, and one counterfeit $50 bill.

ASSAULT, PETIT LARCENY & RESISTING ARREST
John Dickerson, age 25, address unknown, was indicted on March 22, 2013 by a Rockland County Grand Jury for the crimes of assault in the second degree, petit larceny and resisting arrest. District Attorney Thomas P. Zugibe stated that on or about September 29, 2012 at approximately 7:35 p.m., the defendant was observed by store security taking property from the Garnerville ShopRite and loading it into a trash can. As the defendant was leaving the store he observed police presence and returned into the store. After being informed that he would be arrested for larceny, the defendant ran from the police. The defendant was caught by police and as a result of the chase, an uniformed police officer suffered physical injury to his knee.

BURGLARY, ROBBERY & KIDNAPPING
Jose Hernandez, age 24, residing at 2 Amsterdam Pl., Mount Vernon, NY, Ravindra George, age 19, residing at 3012 Barnes Ave., Bronx, NY, and Zachary Johnson, age 32, residing at 2720 Holland Ave. Bronx, NY, were indicted on March 25, 2013 by a Rockland County Grand Jury for the crimes of burglary in the first degree, robbery in the first and second degree (two counts) and kidnapping in the second degree (two counts). District Attorney Thomas P. Zugibe stated that on or about March 1, 2013 at approximately 2:30 a.m., the defendants entered a dwelling at 605 Maplewood Gardens, Nanuet, NY, forcibly stole property from two victims at gunpoint. Prior to taking the property the defendants tied up the victims, who were mother and son. The defendants were apprehended a short time later in the vicinity of the robbery by members of the Clarkstown Police Department.

AGGRAVATED DWI WITH A CHILD & MORE
Juan Martinez-Veliz, age 36, residing at 34 Bethune Blvd, Spring Valley, NY, was indicted on March 20, 2013 by a Rockland County Grand Jury for the crimes of aggravated driving while intoxicated with a child (two counts) and aggravated driving while intoxicated. District Attorney Thomas P. Zugibe stated that on or about January 13, 2013 at approximately 11 p.m., Spring Valley Police responded to a 911 hang up and possible dispute at Bethune Blvd. Police officers observed the defendant in the vehicle pulling out of the driveway. Upon speaking with the defendant, the officers observed the defendant to be in intoxicated condition. A 5-year-old child was also standing on the rear passenger seat without a seatbelt. The defendant failed various sobriety tests and his blood alcohol content was .21%.

SEXUAL ABUSE & ENDANGERING THE WELFARE OF A CHILD
Gary Morris, age 28, residing at 9 Park Street, Spring Valley, NY, was indicted on March 27, 2013 by a Rockland County Grand Jury for the crimes of sexual abuse in the first degree and endangering the welfare of a child. District Attorney Thomas P. Zugibe stated that on or about March 10, 2013 at approximately 7:14 p.m., the defendant approached a 10-year-old girl in a hallway of a church in Spring Valley, NY. The defendant grabbed the girl’s chest area multiple times before she was able to get away from him. The girl did not know the defendant.

CRIMINAL MISCHIEF
Duane Ouderkirk, age 38, residing at 5D Hasbrouck Road, West Haverstraw, NY, was indicted on March 20, 2013 by a Rockland County Grand Jury for the crime of criminal mischief in the third degree. District Attorney Thomas P. Zugibe stated that on or about November 13, 2012 at approximately 8:30 a.m. at the Samsondale Barbershop, in the Village of West Haverstraw, defendant intentionally broke the storefront window by kicking it with his feet. The cost of repair was over $250.

CRIMINAL POSSESSION OF A FORGED INSTRUMENT
Armando Pacheco, age 33, residing at 2 Elmwood Street, NY, was indicted on March 27, 2013 by a Rockland County Grand Jury for the crimes of criminal possession of a forged instrument in the second degree. District Attorney Thomas P. Zugibe stated that on or about December 10, 2012 at approximately 5 p.m., the defendant was found to be in possession of a fake driver’s license.

POSSESSION OF OBSCENE PERFORMANCE BY A CHILD
Ashley Quiroa, age 32, formerly of 46 Pascack Road, Pearl River, NY and currently at 5 Camelot Drive, Goshen, NY, was indicted on March 25, 2013 by a Rockland County Grand Jury for the crime of possessing an obscene performance by a child (29 counts). District Attorney Thomas P. Zugibe stated that on or about October 14, 2010, the Rockland County Sheriff’s Computer Crime Task Force discovered multiple files containing child pornography on the defendant’s computer. The defendant would download the files via a file sharing service.

AUO OF A MOTOR VEHICLE & DWI
Jerson Rivera, age 32, residing at 146 E. Railroad Ave., West Haverstraw, NY, was indicted on March 27, 2013 by a Rockland County Grand Jury for the crimes of aggravated unlicensed operation of a motor vehicle in the first degree and driving while intoxicated. District Attorney Thomas P. Zugibe stated that on or about September 23, 2012 at approximately 10:40 p.m., the defendant was stopped by a Spring Valley police officer while driving on Main Street. The officer observed the defendant to be in an intoxicated state as evinced by the odor of an alcoholic beverage, glassy eyes and impaired motor coordination. The defendant failed three sobriety tests and blood alcohol content was .16%. Further investigation revealed that defendant’s privilege to operate a motor vehicle had been suspended due to a pending DWI charge in the Town of

GRAND LARCENY
Giovanna Scarcella, age 32, residing at 11 Marianne Lane, Valley Cottage, NY, was indicted on March 27, 2013 by a Rockland County Grand Jury for the crime of grand larceny in the third degree. District Attorney Thomas P. Zugibe stated that on or about and between August 24, 2009 and August 23, 2012, the defendant stole over $3,000 from the New York State Department of Social Services when she was working as a nanny and collecting Medicaid benefits.

CRIMINAL POSSESSION OF AN ANTI-SECURITY ITEM
Terry Williams, age 33, residing at 372 Liberty Street, Newburgh, NY, was indicted on March 27, 2013 by a Rockland County Grand Jury for the crimes of robbery in the third degree and criminal possession of an anti-security item. District Attorney Thomas P. Zugibe stated that on or about June 15, 2012 at approximately 3:20 p.m., the defendant attempted to steal property from Hollister in the Palisades Park Mall and was stopped by a loss prevention officer at the exit. The property was found within a booster bag the defendant was holding.
