DA REPORT 3/20/14


AGGRAVATED DWI
Jose Antonio Pichazaca Guaman, age 27, residing at 839th Street, Irvington, NJ, pled guilty on February 24, 2014 to aggravated driving while intoxicated with a child. District Attorney, Thomas P. Zugibe stated that on or about November 3, 2013 at approximately 5:44 a.m. in the Village of Spring Valley, the defendant was found to have been operating a motor vehicle while intoxicated with a child in the vehicle. Sentencing is scheduled for May 5, 2014 before the Honorable Charles Apotheker, County Court Judge.

DWI
Evelyn Aguilar, age 30, residing at 58 Twin Avenue, Spring Valley, NY, pled guilty on February 26, 2014 to driving while intoxicated as a felony. District Attorney, Thomas P. Zugibe stated that on or about October 27, 2013 at approximately 12:21 a.m. on West Eckerson Road in the Town of Ramapo, the defendant was found to have been operating a motor vehicle while intoxicated. The defendant had a previous DWI conviction in 2008 in the Town of Ramapo. Sentencing is scheduled for May 7, 2014 before the Honorable Charles Apotheker, County Court Judge.

ATTEMPTED CRIMINAL POSSESSION OF A FORGED INSTRUMENT
Vito S. Cerbone, age 31, of 3422 Ampere Avenue, Bronx, NY, was sentenced by the Honorable Charles Apotheker, County Court Judge on February 19, 2014 to 1 ½ to 3 years in state prison after pleading guilty to attempted criminal possession of a forged instrument in the second degree, sentence to be served concurrently with another indictment. District Attorney, Thomas P. Zugibe stated that on or about and between October 7 and October 21, 2013, the defendant was found with counterfeit currency. The defendant while at the Stop and Shop in Nanuet, NY, attempted to exchange five counterfeit twenty dollar bills for a legitimate one hundred dollar bill. The defendant also attempted to pay with counterfeit bills while at the Dog House
Restaurant in Nanuet, NY.

CRIMINAL POSSESSION OF A CONTROLLED SUBSTANCE
Juan Medina, age 26, of 67 Church Street, Garnerville, NY, was sentenced by the Honorable Charles Apotheker, County Court Judge on February 19, 2014 to three years in State Prison and three years post release supervision after pleading guilty to criminal possession of controlled substance in the third degree. District Attorney, Thomas P. Zugibe stated that on or about March 23, 2013, the defendant was found to be in possession of approximately 225 grams of cocaine.

BURGLARY

Maury A. Pagan, age 21, of 56 Smith Hill Road, Airmont, NY, was sentenced by the Honorable Charles Apotheker, County Court Judge on March 5, 2014 to one to three years in state prison after pleading guilty to burglary in the third degree. District Attorney, Thomas P. Zugibe stated that on or about January 29, 2012, the defendant acting in concert with another individual stole copper pipe from a building under construction in the Town of Ramapo.
