The driver of a car that killedย a three-month old baby and seriouslyย injured the babyโs motherย and sister was denied early releaseย from prison by the Newย York State Department of Corrections.ย Albert Gomez ran over andย killed the infant during a roadย rage while the family was walkingย along the shoulder of Routeย 59 in Monsey on June 26, 2017.
According to court documents,ย Gomez became angry at a taxi thatย cut him off and drove alongsideย the taxi and onto the shoulder ofย Route 59, striking the family thatย was walking along the roadway.ย The three-month infantโs deathย sparked a call from local politiciansย to install sidewalks alongย dangerous roadways to preventย pedestrians from being struck byย cars and improve overall safety.
Gomez received a very lenientย sentence of 1 1/3โ4 years inย prison under a plea deal with theย Rockland County District Attorneyโsย Office. Based upon the initialย denial of parole, Gomez willย likely serve another 20 months inย prison. Heโs eligible for releaseย on February 20, 2020.
