Driver of Carย that Killed Babyย on Route 59 Deniedย Early Release

The driver of a car that killedย a three-month old baby and seriouslyย injured the babyโ€™s motherย and sister was denied early releaseย from prison by the Newย York State Department of Corrections.ย Albert Gomez ran over andย killed the infant during a roadย rage while the family was walkingย along the shoulder of Routeย 59 in Monsey on June 26, 2017.

According to court documents,ย Gomez became angry at a taxi thatย cut him off and drove alongsideย the taxi and onto the shoulder ofย Route 59, striking the family thatย was walking along the roadway.ย The three-month infantโ€™s deathย sparked a call from local politiciansย to install sidewalks alongย dangerous roadways to preventย pedestrians from being struck byย cars and improve overall safety.

Gomez received a very lenientย sentence of 1 1/3โ€“4 years inย prison under a plea deal with theย Rockland County District Attorneyโ€™sย Office. Based upon the initialย denial of parole, Gomez willย likely serve another 20 months inย prison. Heโ€™s eligible for releaseย on February 20, 2020.
