Residents Sue Piermont Village Board

A group of concerned Piermont residents have successfully sued the Village Board of Trustees and Planning Board, blocking construction of what was described as โ€œa Residential Monstrosity at 447-477 Piermont Avenueโ€ in a statement shared with the RCT.ย 

On October 11, the New York State Supreme Court ruled that Piermontโ€™s planning board had violated New York Stateโ€™s General Municipal Law 239 by unlawfully establishing a Central Business Multi Use District in the village. The CBM, which had been established by the passing of Local Law 4 by village trustees, would have allowed for the construction of a three story, 14 unit dwelling proposed by Piermont Developers LLC.ย 

On April 24, Jananice Young, Laura Healty-Grznar, John Grznar and Valentina Zitt, filed their suit against the village, complaining that Local Law 4 had not been legally adopted. The Plaintiffs successfully argued that the Village of Piermont had not sought the approval of the County Planning board before adopting Local Law 4, and that the CBM the law sought to establish required county approval before being implemented as per Municipal Lawย  239.ย 

New York Stateย  upheld their complaint, finding Local Law 4 invalid, and thus preventing the proposed development.ย
